The following are the terms and conditions of the "2009 Aussie Millions Main Event" (the "Event") PacificPoker PokerNews Qualifiers (the "Qualifiers"). The Qualifiers are organized and promoted by Cassava Enterprises (Gibraltar) Limited (the "Organizer") and iBus Media (Isle of Man) Limited (together – the "Organizers")). Your participation in the Qualifiers shall be deemed to be your complete acceptance of the terms and conditions herein.
1. The Qualifiers will commence on Tuesday January 6, 2009 at 20:00 GMT (the "Start Date") and conclude on Wednesday January 7, 2009 (together – the "Qualifiers Period").
2. Entry to the Qualifiers or the Event is available only to persons who are over the age of 18 (the "Required Age") before the Start Date. You may be asked at any stage to provide the Organizer or a third party with proof of age and/or identity. If you fail to provide such proof or the Organizer discovers, at any stage, that you were not over the Required Age before the Start Date, the Organizer, at its sole discretion, will be authorized to disqualify you from participating in the Qualifiers andor the Event andor withdraw any prizes won by you in the Event or the qualifiers.
3. Unless provided with special written permission by the Organizers, employees and relatives of employees of the Organizers and any entities affiliated or related to the Organizers shall not be eligible to enter the Qualifiers and the Event. For the purposes herein, the term “relative” shall mean spouse, partner, parent, child or sibling.
4. In order to take part in the Qualifiers and in the Event you must be a pacificpoker.com member and have an active user account with the Organizer at www.pacificpoker.com before the Start Date.
5. In order to take part in the Qualifiers and in the Event, you must be a referred PokerNews players; i.e., you must sign up through a link on PokerNews or PokerNews related properties. Alternatively you must provide your PacificPoker username to ChipMeUp/PokerNews staff no later than 2 (two) calendar days prior to the tournament.
6. The winner of the Qualifiers (the "Winner") shall win a prize (the "Prize") in the amount of USD 12,500 consisting of: (i) A buy-in to the Event, (ii) Accommodation at the Crown Promenade Hotel in connection with the Event, (iii) USD 2,500 for related travel expenses, (iv) Invitations to the Team PokerNews Welcome dinner and Team outing.
7. If the total amount of the buy-ins for the Qualifiers exceeds USD 25,000, the Organizer may, at its sole discretion, offer an additional Prize to the next runner-up, and repeat this (with the following runner-up), at its sole discretion, for any additional amount of buy-ins equivalent to USD 12,500.
8. Any amount of buy-ins which is not used to provide for the Prizes will be distributed by the Organizer in accordance with its standard payout structure and will be at its sole discretion.
9. The Prize is neither transferable nor exchangeable and cannot be exchanged or redeemed for money or money's worth unless by the Organizer and at its sole discretion.
10. The Organizer's decision is final with respect to all matters relating to the Winners and the awarding of the Prize(s), and shall not be subject to review or appeal by you or by any third party.
11. The Winner(s) the Prize shall make themselves available to attend the Event and shall bear the sole responsibility for booking the flights and/or other travel arrangements and accommodations and for having a valid passport, visa and all other required documentation for the purpose of travelling to the Event.
12. If for any reason a Winner who has won the Prize fails to attend the Event, such Winner will be deemed to have forfeited the Prize and shall have no claim whatsoever against the Organizer in such regard, for any reason whatsoever. In such an event, the Organizer reserves the right to transfer the Prize to a person of its choosing at its sole discretion, or use the Prize in any other manner at its sole discretion.
13. In the event that for any reason whatsoever any Winner of the Prize fails to comply with all the arrangements as instructed by the Organizer, such Winner shall be deemed to have forfeited his / her right to the Prize and to participate in the Event and the Organizer shall not have any obligation whatsoever to compensate the Winner in any way.
14. Any Winner who has won the Prize and participates in the Event shall be subject to the Event's terms & conditions. In the event such Winner shall refuse to accept the Event's terms & conditions he / she shall not be allowed to participate in the Event and will be deemed to have forfeited the Prize without the right to any compensation whatsoever. In such an event, the Organizer reserves the right to transfer the Prize to a person of its choosing at its sole discretion, or use the Prize in any other manner at its sole discretion.
15. It is hereby clarified that the Organizers are not managing, operating, hosting or conducting the Event, nor are they responsible in any manner for the Event's management, duration, dates, location, rules, terms and conditions. You hereby acknowledge that you will not have any claim in respect of the Event (including, but not limited to, its cancellation) towards the Organizers, their legal representatives, affiliates, subsidiaries, agencies and their respective officers, directors, employees and agents, nor will they be held responsible or accountable for the Event or in connection with it.
16. The Organizer reserves the right to photograph, film, videotape, and/or record in any other manner, and to broadcast and distribute any such photograph, film, videotape or recording of the Qualifiers and/or the Event in any media and by means of any technology. Therefore you hereby grant the Organizer the right to photograph and film you throughout your participation in the Qualifiers andor the Event and acknowledge that the Organizer and its affiliated companies shall have a royalty-free, perpetual and world-wide right to use all materials produced in any manner and in any media.
17. You hereby acknowledge that should you win the Prize, you will wear Pacific Poker, PokerNews and ChipMeUp branded clothing at all times, whilst competing in the Event. These will be provided free of charge to the Winner(s).
18. The Winner(s) commit that should they receive any monetary prize during the Event and in connection with it (the "Monetary Prize"), they will transfer 50 (fifty) percent of the Monetary prize to the Organizer, to be distributed between the 30 (thirty) participants in the Qualifiers who finish immediately after the Winner(s), as follows: (i) Winner(s) – 50 (fifty) percent of the Monetary Prize (ii) First non-Winner runner-up – 5 (five) percent of the Monetary Prize (iii) Second non-Winner runner-up – 3 (three) percent of the Monetary Prize (iv) Third non-Winner runner-up – 2 (two) percent of the Monetary Prize (v) Fourth non-Winner runner-up – 2 (two) percent of the Monetary Prize (vi) Fifth non-Winner runner-up – 2 (two) percent of the Monetary Prize (vii) Sixth non-Winner runner-up – 2 (two) percent of the Monetary Prize (viii) Seventh non-Winner runner-up – 2 (two) percent of the Monetary Prize (ix) Eighth non-Winner runner-up – 2 (two) percent of the Monetary Prize (x) Ninth non-Winner runner-up – 2 (two) percent of the Monetary Prize (xi) Tenth non-Winner runner-up – 2 (two) percent of the Monetary Prize (xii) Eleventh non-Winner runner-up – 2 (two) percent of the Monetary Prize (xiii) Twelfth non-Winner runner-up – 2 (two) percent of the Monetary Prize (xiv) Thirteenth non-Winner runner-up – 2 (two) percent of the Monetary Prize (xv) Fourteenth non-Winner runner-up – 2 (two) percent of the Monetary Prize (xvi) Fifteenth non-Winner runner-up – 2 (two) percent of the Monetary Prize (xvii) Sixteenth non-Winner runner-up – 2 (two) percent of the Monetary Prize (xviii) Seventeenth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xix) Eighteenth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xx) Nineteenth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxi) Twentieth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxii) Twenty first non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxiii) Twenty second non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxiv) Twenty third non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxv) Twenty fourth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxvi) Twenty fifth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxvii) Twenty sixth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxviii) Twenty seventh non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxix) Twenty eighth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxx) Twenty ninth non-Winner runner-up – 1 (one) percent of the Monetary Prize (xxxi) Thirtieth non-Winner runner-up – 1 (one) percent of the Monetary Prize Payment to the non-Winner runner-ups will be facilitated by deposits into their account with the Organizer at www.pacificpoker.com.
19. For the purpose of fulfilling the Winner's obligations under Article 18, the Winner may be required to sign a contract in accordance with these obligations. Failure to sign such a contract will be deemed as if the Winner forfeited his / her right to the Prize and to participate in the Event and the Organizer shall not have any obligation whatsoever to compensate the Winner in any way. The Winner(s) also hereby authorize the Organizer to withdraw funds from their account with the Organizer at www.pacificpoker.com so as to meet their obligations under Article 18.
20. Notwithstanding the above, the Organizer assumes no liability, obligation or responsibility for the existence of any Monetary Prize, nor to being liable, obligated and responsible for the payment of any part of the Monetary Prize to the non-Winners runner-ups. The sole responsibility for such payment rests with the Winner who received a Monetary Prize and you will have no claim against the Organizer in this respect.
21. Your participation in the Qualifiers is deemed to constitute your agreement that the Organizer may use your name, likeness or image for marketing and promotional purposes without being required to make any payment to you and you expressly hereby grant the Organizer the right to do so and waive any claims against the Organizer in this regard.
22. In the event that the Organizer shall deem that you have acted in collusion with other entrants, executed any act in bad faith in relation to the Qualifiers, conducted play in a fraudulent or unethical manner, acted in a detrimental manner to the conduct of the Qualifiers or not adhered to the Organizer's terms and conditions as found at http://www.pokernews.com/freeroll-terms.htm, you shall be excluded from the Qualifiers and will therefore be ineligible to win any prizes, including the Prize.
23. By entering the Qualifiers you agree to release, discharge and hold harmless the Organizer, its legal representatives, affiliates, subsidiaries, agencies and their respective officers, directors, employees and agents from any damages whatsoever, including any personal injury suffered or sustained in connection with the acceptance of any of the prizes, including the Prize, and with the participation in the Qualifiers and the Event.
24. If you receive any amount of money as part of the Qualifiers andor the Event, you shall be solely responsible for any taxes levied in relation to the receipt of such monies.
25. The Organizer reserves the right, at any time, to cancel, modify or suspend the Qualifiers, the Qualifiers Period, the Start Date, the dates and location of the Qualifiers, at its sole discretion. You hereby waive any claim against the Organizer in this respect.
26. The Organizer reserves the right to alter these terms and conditions at any time and at its sole discretion.
27. These terms and conditions have been drafted in the English language. In the event of any discrepancy between the meanings of any translated versions of these terms and conditions and the English language version, the meaning of the English language version shall prevail
28. These terms and conditions and any matters relating hereto shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the Royal Courts of Justice, London, England.
